Trischan, who served as the program manager of diversity, equity, and inclusion (DE&I) for the franchise, alleges a combination of harassment, racial discrimination, retaliation, and wrongful termination during her tenure from September 2022 to July 2023.
The Allegations
Trischan's claims center around her experience working under a new diversity council within the organization. According to her attorney, Sheree Wright, Trischan "endured overt racist comments and a hostile work environment that went unaddressed despite being reported to HR and executive leadership." Trischan's accusations not only challenge the ethical backbone of the Suns' management but also question the effectiveness of their DE&I initiatives.
Two executives mentioned in her complaints, Kyle Pottinger and Melisa Goldenberg, are no longer associated with the Suns, adding a layer of complexity to the situation. Moreover, Jason Rowley, the former team president and CEO, resigned in February 2023, prior to Trischan’s official departure in July, after being placed on a performance improvement plan in late May. The gravity of Trischan's lawsuit is somewhat mitigated by the fact that her claims were previously dismissed by both the U.S. Equal Employment Opportunity Commission and the Arizona Attorney General's civil rights division in November, citing insufficient information. These dismissals have been leveraged by the Suns in their defense against the lawsuit. Stacey Mitch, Senior Vice President of Communications for the Suns and the WNBA's Phoenix Mercury, stated unequivocally, "Her claims have been without merit from Day 1, and now this lawsuit, in which she is seeking $60M, is based on the same claims that were just dismissed. We are fully confident the courts will agree her story is completely fabricated."
The Defense of the Diversity Council
Central to the discord is the newly established diversity council, which according to the Suns is composed of the entire executive team and other organizational leaders. In a statement, the organization asserted, "The purpose of the diversity council...is to listen to the diversity data and information on DE&I initiatives to continue to further the organization's DE&I commitment." This statement reflects the Suns' endeavor to demonstrate a commitment to diversity and inclusion at the highest levels of the organization, although this very initiative has now come under scrutiny.
